An Overview

The property is a 30,000 sq ft warehouse in West Yorkshire with offices, parking and a shared service yard. Our client wished to take a short term let and sought to limit their dilapidations liability. We were instructed to prepare a photographic schedule of condition. Our team of local experts identified multiple issues before lease commencement to limit the client’s liability.

The Challenge

Our client wished to take a short-term let of a 30,000 sq ft warehouse in West Yorkshire, which also comprised offices, parking and a shared service yard. The poor condition of the property at lease commencement meant that the client sought to limit its dilapidations liability on the short-term let. We were instructed to prepare a photographic schedule of condition in short timescales to record the condition of the premises immediately prior to lease commencement.

Our Solution

Our experienced team of local property experts inspected all areas of the property to take a detailed record of the condition of the premises, as well as identifying issues with the extent of demise and draft lease.

The Results

  • Our report was prepared promptly, ensuring the letting was not held up, reducing potential risk of delayed occupancy for the client.
  • We provided additional expert advice, identifying landlord’s plant in a number of locations, removing them from the tenant’s demise.
  • We reviewed the draft lease and suggested to the solicitor a number of amendments that were incorporated into the lease to limit the tenant’s repair liability significantly more than originally proposed.
  • The tenant was able to occupy the premises as planned with future liabilities limited significantly, with a more accurately defined extent of demise than originally proposed.
