Dilapidations
Lambert Smith Hampton's (LSH) Dilapidations Schedule and Assessment Service provides advice to both landlords and tenants on the management of dilapidations liability.
During tenancy, a property is likely to suffer a degree of general wear and tear or may even fall into an unacceptable state of disrepair.
Under the commercial lease, and specifically with reference to the Schedule of Condition and the Dilapidations Schedule, the landlord may seek various forms of reparation or recompense in order that the property may be restored to the state of repair as defined in the original lease.
A Dilapidations Schedule may be served by the landlord during or on termination of the lease. It places the responsibility upon the tenant to assess its liability for repairs by reference to the original Schedule of Condition, and respond to the landlord.
For both parties, entering into such negotiations without proper advice can have dire financial consequences.
